WARRANTY ON OUR POOL SHELLS
1. This warranty is valid provided the following conditions have been met:
a. The shell installation was done according to National & local building regulations of South Africa;
b. 4EVA has received the full payment of the pool shell on delivery;
c. A minimum of 10 to 1 clean sand and cement mix (backfill mix) was used for the installation of the pool shell.
2. An assessment of the backfilling will be done by a 4EVA representative to determine whether above mentioned building regulations & installation procedures were followed.
3. The fibreglass pool shells come with a limited 15-year structural warranty. The 4EVA Fibre Pools (hereinafter 4EVA) warrants its fibreglass pool shells to be structurally sound for the 15-year warranty period. Structurally sound having the meaning that the fibreglass pool shell will be capable of containing and holding water. In the event of failure of the pool to contain water, 4EVA will repair the pool so that it does contain and hold water. Repairs may require modification to the pool. 4EVA will not compensate the client for loss of time or use of the pool, inconvenience, or the cost to refill the pool with water.
4. All surface repairs shall be performed by 4EVA, or personnel authorized by 4EVA to make such repairs, using the same colour materials as used on the original pool shell. 4EVA does not warrant that the colour will match exactly; there might be a slight shade or colour variance observable.
5. The warranty covers a 6-month repair period on hairline cracks, gel coat chips and blistering. After the initial 6-month period this warranty excludes discoloration, staining, fading, hairline cracks, blistering, gel coat chips or cracks, surface yellowing or roughness after manufacture.
6. Any pigmentation other than white and light blue, is not covered by this warranty. On darker colours white streaking is unavoidable.
7. Poor maintenance such as algae infestation, calcium scale or other mineral vegetation deposits or faults arising from misuse or abuse of the surface, or the maintenance of incorrect water balances will not be covered under the warranty.
8. 4EVA, at its sole discretion, shall make the determination as to repairing or replacing the pool in the event of major structural fault. 4EVA shall not be liable or responsible for any loss or damage to property, including or not limited, to any fencing, shrubbery, walks, trees, patios, water or other improvements except for any gross negligence on behalf of 4EVA.
WARRANTY EXCLUSIONS:
9. This warranty is not transferrable to a third party and is only applicable to the original purchaser.
10. 4EVA does not provide a warranty for the workmanship of the installer. Any damages caused to the pool shell due to poor workmanship will not be covered by this warranty.
11. 4EVA cannot take responsibility for shell problems occurring as a result of incorrect installation.
12. In the event of high-water tables, bulging, sagging or cracks due to underground water and/or flooding, all warrantees will be voidable.
13. The 15-year limited structural warranty does not include pipe fittings, skimmer, inlet fittings, light niche or any other equipment or materials connected to the pool.
14. The coping/paving is not considered part of the pool for warranty purposes.
15. Due to the nature of the product & no warranty back up from the manufacturer & supplier, 4EVA cannot give a warranty on any electrical components, which include the cable, pool light, timer, distribution board and circuit breakers.
16. The pool is designed to remain full of water at all times. The pool shell may be damaged if the water level is allowed to drop below the skimmer outlet. No warranty if this occurs.
17. The pool shell may be damaged and separation from the concrete decking may occur if the pool is allowed to overflow or heavy water drainage is allowed to overrun the decking into the pool shell. Do not allow the water to overflow. Keep the water level in the middle of the skimmer at all times. No warranty if this occurs.
18. Where the client does not keep runoff water away from the pool areas bulging may occur. No warranty if this occurs.
19. Where the client empties the pool shell without the authorization of 4EVA the warranty will automatically be void.
20. All warrantees are immediately null and void should any goods be tampered with or should the seals on goods be broken by anyone other than 4EVA or should the goods be used, maintained or stored outside the Manufacturer’s specifications.
21. Damages caused by any misuse, abuse or neglect caused by the client or any third party who has access to the swimming pool. No warranty if this occurs.
22. Accidental damages caused by the client or any third party who has access to the swimming pool.
DISCLAIMER:
I. The relationship between 4EVA and any installers is that of independent contractor and shall never be deemed or construed to be an employment, partnership, joint venture, agency relationship, or any other similar relationship. No installer has any authority of any kind whatsoever to create any binding obligation on the part of 4EVA or any partner or affiliate of 4EVA.
II. These independent installers are not agents for 4EVA and do not have the authority to act for or on behalf of 4EVA. Any pool shell problems arising as a direct result of installation must be taken up with the installer/contractor.
III. 4EVA disclaim any and all liability for any act or omission on behalf of any installer or retailer. 4EVA’s obligation is limited to its warranty of 15 years structural warranty, 6 months on the gel coat / mosaics / cosmetics of the pools should the issue arising be as a result of manufacturing.
IV. Please ensure that your new swimming pool is insured with your property insurer for damages caused by acts of nature.
